Not insolvent

Post  craftychez on Sat 17 Jan 2009, 7:24 pm

hi,
I worked at burton. I, along with the other girls at the store have all recieved letters from the administrators, stating that administrators were appointed on 23rd december 2008.

Also included with this, were forms to apply for wages, holiday pay etc.

Yes, we all filled them out, but the letter today states Craft Central is not an insolvent company, so no money will be paid out from the Government!

I have not received letter either, but I can assure you he won't get away with it with me.I will be taking legal advice and will be getting the papers involved. I wonder if Aston Trading would like their name connected with him once his name is blackened!!

Surely if this was the case would the administrators have gone to all that expense sending those forms out for nothing.
Isnt it a bit strange that with all the people who worked for c c only one person has recieved this letter ! up to now that is.

The trouble is, whilst what Dan and Pat have done is morally wrong, swanning off and leaving us all with no wages and no jobs, unfortunatly it is not legally wrong, they set themselves un as a limited liability company, and when things got tough they were able to walk away, leaving us high and dry, only if they are made bankrupt (which their limited liability tends to protect them from, unless they have given directors guarantees) would they be excluded by law from becoming directors of another company. One of those situations were the Law sucks Sad

Re: NOT INSOLVENT

I have just spoken to the Insolvency Service. As of January 5th, the company was not registered as insolvent on company house records. These letters are sent to the employees before the insolvency service are informed. I was told that we should phone the insolvency service when this letter is recieved as this will record us as creditors. I gave the administrators details to the person I spoke to ( very helpful lady ) and they will now take it up. She told me that payment could then be expected between 4 to 6 weeks. So, as soon as you get this letter, phone the insolvency office..you should have a direct number on the letter.

Well I havent recieved a letter and i have just come off the phone and they know nothing about this letter and to me it sounds like someone is either sending out letters as a malice thing or this has gone out by accident from whomever but leonard curtis said we WILL get our pay in 4 to 8 weeks as from when that is from they couldnt say, they also said it would have been quicker if people had sent in their forms as soon as they got them.

Apparantly our forms were sent to Bury instead of Birmingham! I didn`t mean to cause panic but only asked if anyone else got the letter, which did get sent to some of us
